Please read the General Terms and Conditions (hereinafter: GTC) carefully if you wish to become a customer or user of our webshop and only use our services if you agree with all of its points and consider them binding on you.
General information
These general terms and conditions apply to all e-commerce services provided in Hungary which are provided by the www.hellozalakaros.hu via the e-shop on the website.
The personal scope of these GTC shall apply to all commercial transactions in the territory of Hungary between the parties as defined in this contract.
A www.hellozalakaros.hu purchase of goods in its webshop is possible by placing an order electronically, as specified in these general terms and conditions.
By signing the online shop, anyone is entitled to use the services of the online shop, provided that they accept the terms and conditions of these general terms and conditions as binding on them.

RANGE OF SERVICES AVAILABLE FOR PURCHASE
The service provider operates an on-line internet sales system for the sale of products and services (gift vouchers, coupons and/or tickets) of Zalakaros Spa Ltd., hereinafter referred to as "goods".
The service provider does not use open-ended or flat-rate contracts. The contract between the service provider and the customer is concluded for a fixed term, the duration of which is until the date of receipt of the products or the date of use of the services. The contract shall not be converted into a contract of indefinite duration.
No deposit or other financial security is provided by the customer to the service provider.

THE GROUPING OF PRODUCTS OFFERED
On our website, we sell products and services (gift vouchers, coupons and tickets) collectively referred to as goods. The goods are delivered to the customer by post or courier. The essential characteristics of the goods can be found directly next to the tickets and vouchers to be purchased. The images on the website relating to the provision of services are for information purposes only, and are illustrative in places.
The website provides full information on the goods available at the time of purchase, their gross price, including the amount of VAT payable.
The official currency of the website is Hungarian Forint, and payment can be made by credit card or bank transfer.
Details of the scope of the goods:
Definition of the product: the range of products sold by the spa with its own logo.
The concept of service: services means the sale of gift vouchers, coupons, admission tickets redeemable for services provided by the spa, or e-tickets for programmes, printed by the spa itself:
From gift voucher definition: a serially numbered gift voucher entitling the customer to use the services selected and purchased in the online sales system by presenting and making an appointment at the cash desk of Zalakaros Spa Ltd.
A coupon definition: a serially numbered, bar-coded cash substitute that can be purchased in denominations of 1.000 Ft and redeemed for any service that can be purchased by the spa at ticket offices.
A ticket ticket: a ticket purchased through an online sales system that allows the customer to Bath (In case of purchase of a discounted ticket, you will be required to present the documents entitling you to the discount).
From e-ticket ticket for participation in a programme (e.g. a night event) organised by the spa at a given time and purchased through an online sales system, which allows the purchaser to Bath entitles the holder to access to the venue of the programme at the spa after being scanned at the entrance gates
The use of the services is ensured by the purchase of gift vouchers, coupons or tickets sent by post, with the exception of e-tickets. The rules for e-tickets are set out in the chapter on self-printed tickets.
The services can be purchased in the family, adventure and spa baths operated by Zalakaros Spa Ltd.
In addition to the purchase of vouchers entitling the user to use the services, the user enters into a service relationship with the service provider for the provision of the service.
The service provider declares that it holds the operating and operating licences in accordance with the legislation in force for the services it sells.

The images on the website relating to the provision of products and services are for information purposes only and are sometimes illustrative. Here you can add the product to your shopping cart.

During the shopping process, on the so-called „shopping cart“ page, the customer has the possibility to modify the contents of the shopping cart, delete it or select new products. The order can then be finalised.

The customer fills in the details required for the purchase. If the data needs to be corrected, the customer can do so without limitation as long as he/she has not clicked on the „checkout“ button. The payment is then made through the payment provider's interface, depending on the payment method chosen.
- choose payment method: bank transfer or credit card payment. In case of bank transfer, the further steps will be indicated in the confirmation e-mail. After payment by bank card, the payment process continues on the payment provider's interface. A confirmation e-mail will be sent to the customer's e-mail address after the payment has been successfully completed. In case of payment by SZÉP card, the payment instructions of the bank provider of the SZÉP card must be followed.

If you have any technical questions or if you are unable to place your order, the service provider will be at your disposal at the telephone number or e-mail address specified in these general terms and conditions.
PROCESSING ORDERS
After each successful order, the customer will receive an automatic confirmation to the e-mail address provided during the ordering process, which will include the order details and any further steps necessary to finalize the order. The service provider reserves the right to refuse all or part of an order that has already been confirmed, if the products or services cannot be used for technical reasons or for reasons beyond the control of the service provider.
Customer service will start processing your order on the first working day after you place it. Once payment has been made, the invoice will be issued and the voucher, coupon, ticket or product for the service ordered will be sent by post. Exceptions to this rule are self-printed e-tickets, for further information on which please see the section on self-printed tickets.
The prices indicated in the shop are valid (gross) consumer prices. The total amount of the consideration for the contracted service, plus tax, is shown on the so-called „shopping cart“ page of the shopping interface, indicating the gross product, service or entry price and the cost of postage. No additional cost to the consumer may be incurred over and above the gross prices indicated at the end of the purchase process.
Where a special offer is available, it will be indicated separately in the price of each product or service. The service provider cannot offer any further discount on the special prices.
With regard to the price of the goods, the service provider reserves the right to modify the price of the goods, provided that the modification shall enter into force at the same time as the publication of the modification on the website of the webshop. The modification shall not adversely affect the price of the goods already ordered. If, despite all the care taken by the service provider, an incorrect price is displayed on the webshop, the service provider is not obliged to sell the goods at the incorrect price, but may offer to purchase the goods at the correct price, in the knowledge of which the buyer may withdraw from the purchase.
The contract between the parties is concluded upon delivery of the confirmation sent by e-mail by the service provider.
The service provider reserves the right to change the offer of its webshop without prior notice, to limit the availability of certain goods or to change the start and end dates of advertised promotions.
The service provider accepts no legal responsibility for any changes made above.
By clicking on the checkout button, the customer accepts the general terms and conditions of the service. By concluding the contract, the customer accepts the terms and conditions set out in these general terms and conditions, in particular the pre-contractual information on contracts concluded between persons not residing at home, as defined in Article 11 of Government Decree 45/2014 (26.II.26.). By placing an order for the service, the customer accepts and acknowledges that he/she is bound by the terms and conditions and the data processing policy for the processing of his/her data necessary for the use of the service.
A contract concluded between the parties by electronic means is not a written contract, it is not stored in hard copy and is therefore not accessible afterwards.
The conclusion of the contract is evidenced by the electronically stored purchase data, which are kept by the service provider for the period specified in the legislation on accounting and taxation.
The service provider reserves the right to refuse the customer's order in justified cases, in particular in the event of false or incomplete data. The customer assumes responsibility for the accuracy of the data provided. The service provider shall not be held liable in the event that the e-mail address provided by the customer is incorrect.
The customer undertakes to notify the service provider's customer service immediately in the event of any unauthorised use of his/her data or any other breach of security. The service provider is entitled to delete obviously incorrect or false data, and in case of doubt, is entitled to verify the authenticity of the customer.
By using the service, the customer consents to the use of his/her data by the service provider for the purpose of providing him/her with direct and immediate information on any relevant circumstances relating to the goods purchased.
THE METHOD OF PAYMENT FOR THE SERVICES ORDERED
Paying by credit card is a convenient and secure way to shop in our store. After ordering the goods you have chosen, you will be redirected to the OTP Simple Pay payment service provider page, where you can pay with your bank card through the encrypted transaction used by the Bank, which is currently considered the most secure. All our customers have to do is click on „pay by credit card” when selecting the payment method and then enter the card number, expiry date and three-digit security code on the Simple Pay payment server. Simple Pay accepts VISA, VISA Electron, MasterCard, Maestro cards.
We can only accept cards issued for electronic use only if the bank issuing the card authorises its use! Please check with your bank whether your card can be used for online purchases. After a successful purchase, Simple Pay will issue an authorisation number for the transaction, which you should write down or print out the whole page. If the transaction is unsuccessful, Simple Pay will send you an error message with the reason for the error.
The confirmation of the purchase will be sent back to the e-mail address provided by the customer. The service provider is not liable if the e-mail address or other data provided by the customer is incorrect.
Placing an item in the shopping cart does not in itself oblige the customer to purchase it. If the customer does not wish to purchase the product and/or service of his/her choice, he/she may remove it from the shopping cart at any time or delete the entire contents of the shopping cart.
The electronic receipts of the purchase are stored by the service provider at its own headquarters or in the server park where the servers are stored.
DATA TRANSFER DECLARATION

SPECIAL RULES FOR SELF-PRINTED PASSES
In case of purchase of the programs, the service provider will send the self-printed e-tickets as an e-mail attachment in PDF format to the e-mail address provided by the customer, after verifying the successful crediting of the purchase amount. The e-ticket is printed by the customer himself.
The printed e-ticket can only be used by the customer if the barcode is scannable. The customer bears sole responsibility for the loss, theft, misprinting, copying or multiple printing of the printed pass.
The customer must bring the printed e-ticket with him/her when using the service. The customer acknowledges and expressly agrees that the barcode on the pass will be electronically checked and immediately invalidated by the service provider upon entry. Following the invalidation, any further attempts to enter the premises will be invalid and therefore ineffective, and the customer may be refused entry, regardless of whether the person presenting the invalid ticket is the same person who originally purchased the e-ticket. No compensation shall be payable by the service provider for such exclusion.
In connection with the use of e-ticketing, a legal relationship and service obligation is established with the person presenting and handing over the e-ticket. The content of the legal relationship is defined by the rules and regulations available on the website of the service provider (www.hellozalakaros.hu) and in the guest rooms of the service provider.
The e-ticket is freely transferable. The customer declares that he/she will only transfer the e-ticket to another person if the new e-ticket holder accepts the general terms and conditions of the service provider and the other internal rules and policies of the service provider in relation to the use of the e-ticket.
The e-ticket entitles its holder to a single access.
WARRANTY AND GUARANTEE
The service provider informs the customer that the provisions of the Government Decree 151/2003 (IX.22.) on the provision of the service are not applicable to the use of the service.
The customer may assert claims arising from defective performance in accordance with the provisions of Chapter XXIV of the Act of 2013, Act V of 2013 (Civil Code).
In the event of defective performance, the buyer may also claim damages pursuant to § 6:174 of Act V of 2013.
According to the Civil Code, in the event of defective performance by the service provider, the customer can choose to request the contractual performance of the service or withdraw from the contract. The customer may switch from one of the chosen rights of warranty to another, but the cost of the switch must be borne by the customer, unless the service provider has given a reason for the switch.
The customer is obliged to notify his/her warranty claim immediately, but at the latest when leaving the place of service.
After leaving the place where the service is provided, the customer must prove that the defect detected by him was already present at the time of the service.
Anyone may use the services of the complex operated by the service provider only at their own risk. Services may not be visited while under the influence of intoxication, drugs or other mind-altering substances, even if a valid pass or voucher is presented.
A video camera system is permanently in operation at access points and in areas where security is at risk. The recordings are stored in accordance with legal requirements. If the recordings are not used within the given period, they are deleted. The release of the recordings is only possible upon request of the competent authorities.
In the case of a customer who violates the service provider's rules and internal regulations, the customer may be excluded from using the service. In the event of exclusion for such a reason, the service provider is not liable for compensation.
The service provider reserves the right to theoretically limit some of the services for technical or maintenance reasons.
The service provider is not obliged to compensate the customer if it is unable to provide the service in whole or in part due to force majeure. Such an event shall be deemed to be, in particular, but not exclusively, war, insurrection, terrorist act, strike, accident, fire, blockade, flood, natural disaster, serious energy supply disruption or other unforeseeable and unforeseeable obstacle or cause independent of the operation of the service provider.
DRUG OF ACCEPTANCE
According to the provisions of Article 29 (1) (l)) of Government Decree 45/2014 (II.26.), the customer has no right of withdrawal in the case of the purchase of e-tickets, taking into account that the service sold by the service provider is related to leisure activities and the parties have agreed on a deadline for performance.
Although the customer does not have the right of withdrawal, in the event of a circumstance beyond the customer's control, a new date for the provision of the service may be requested on the basis of an individual agreement with the service provider. The latest time at which such a change may be made is 15.00 on the 3rd working day preceding the original date.

www.hellozalakaros.hu does not store and does not pass on any data relating to your purchase. In accordance with the current legislation on accounting, the billing address provided by the customer and the invoice data are stored by the service provider for a period of five years, as specified in the regulation. The personal data provided will be treated confidentially and will not be disclosed to third parties.

www.hellozalakaros.hu is the property of the provider and is protected by copyright. The photos and textual information on the website may be used for purposes other than personal use only with the prior written permission of the provider.

TECHNICAL LIMITATIONS OF THE SERVICE PROVIDER
The customer acknowledges that due to the characteristics of the Internet, the continuous operation of the system may be interrupted despite the prior knowledge and intention of the service provider. The service provider does not guarantee the fault-free, uninterrupted operation of the service and the related website, or that access to the service will be uninterrupted or error-free.
The service provider is entitled to suspend the service partially or completely without any prior information or notification in order to maintain the linked website or for other security reasons. The provider is liable only for damages caused by intentional or grossly negligent errors for which it is responsible. The extent of liability may not exceed the amount of each purchase transaction.
The customer acknowledges that the service provider is not responsible for any damage or misuse that may occur during the payment by credit card.
The service provider excludes its liability for any damage caused by the customer or a third party due to the contract or unlawful act or omission.
FINAL PROVISIONS
We would like to inform customers and users that the Code of Conduct as defined in Article 11 (u) of Government Decree 45/2014 (26.II.) on the prohibition of unfair commercial practices against consumers is not available at the company.
The purchaser or user has the possibility of out-of-court settlement in the event of a dispute concerning the quality, safety, application of product liability rules or performance of the contract, pursuant to Articles 18 and 20 of the CLV Act of 1997. For this purpose, the buyer or user may apply to the Conciliation Board of the place of residence or stay.
